- Acceptance of These Terms
By accessing or placing an order through www.canvaswallgallery.com, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with these Terms, you should not use this Website.
- Products and Orders
Canvaswallgallery offers decorative wall art and related wall décor products for customers located in Europe and the United States. Product descriptions, photographs and specifications are provided to assist customers before placing an order. Orders are subject to acceptance following successful verification and processing.
- Order Processing and Delivery
Orders are dispatched from Canada.
Order processing normally requires 1–3 business days. Following dispatch, the estimated delivery time is 5–9 business days, depending on the destination and carrier operations.
Deliveries are arranged through recognised courier services, including DHL, FedEx and UPS Priority services where available.
Email notifications are automatically sent to the email address provided during checkout when significant shipment events occur, including order dispatch, carrier acceptance, transit updates and local delivery progress.
Where delivery exceeds the standard delivery period, Canvaswallgallery will investigate the shipment with the relevant carrier. Following completion of the investigation, an appropriate resolution, which may include a replacement shipment or a full refund, will be determined according to the circumstances.
- Transfer of Risk
For customers located in Europe, the risk of loss or damage to goods passes to the customer only when the goods have been physically received by the customer or a person identified by the customer to accept delivery, in accordance with applicable consumer legislation.
For customers located in the United States, risk passes upon physical delivery to the customer or the customer’s authorised recipient.
- Right of Withdrawal and Returns
Customers located in jurisdictions where a statutory right of withdrawal applies may cancel their purchase within 14 days after receiving the goods without providing a reason, provided the returned items remain in their original condition and are returned in accordance with the return instructions supplied by Canvaswallgallery.
If an item arrives damaged, defective or materially different from the order, customers should contact decor@canvaswallgallery.com within a reasonable period after delivery and provide photographs showing the condition of the item. Following review, a refund or replacement may be provided where appropriate. In such circumstances, the damaged item is not required to be returned unless otherwise requested.
- Customer Responsibilities
Customers are responsible for providing complete and accurate order, delivery and contact information when placing an order. Canvaswallgallery cannot be responsible for delays or delivery issues arising from incorrect or incomplete information supplied during checkout.
- Limitation of Liability
Nothing in these Terms excludes or limits any statutory rights that cannot be excluded under applicable law. To the extent permitted by applicable legislation, Canvaswallgallery shall not be liable for indirect, incidental or consequential losses arising from circumstances beyond its reasonable control.
- Governing Law
These Terms of Service shall be governed by the applicable laws of the Province of Ontario and the federal laws of Canada applicable therein, unless mandatory consumer protection legislation in the customer’s place of residence provides otherwise.
